From January to April 2019, Zhao Moumou went to the mountains around the villages of Juxian County at night, using strong light for irradiation, and at the same time using thin dogs and hand-copied nets and other tools to illegally hunt, hunting a total of 41 wild animals such as hares and pheasants.
On April 8 of the same year, the Ju County Public Security Bureau received a report from the public that 1 dead hare, 1 dead yellow ferret and 10 live toads (released) were found in the house rented by Zhao.
On March 17, 2020, the Ju County Procuratorate filed a public indictment with the Ju County Court on Zhao’s suspicion of illegal hunting, and the court fully adopted the procuratorate’s facts, qualitative determination opinions and sentencing recommendations, and sentenced Zhao Moumou to one month’s detention and two months’ probation on suspicion of illegal hunting.
“Violating hunting laws and regulations, hunting in a game reserve area, during a prohibited hunting period, or using prohibited tools or methods, destroying wildlife resources, and the circumstances are serious, shall be convicted and punished as the crime of illegal hunting in accordance with the provisions of the second paragraph of Article 341 of the Criminal Law.” The prosecutor in charge said.
Hunting of the Grade II protected wild animal kestrel
Yu Moumou hunted a wild bird in a vacant land in a residential area in a village in Ju County by putting bait in a birdcage and kept it for a period of time. When Yu Moumou was selling on the Internet, he was discovered and reported by enthusiastic people. The captured birds were identified by the relevant departments as national second-class protected wild animals kestrels. The captured kestrel survived well, and after investigation and evidence collection, it was taken to the wild by the police handling the case and released.
The Ju County Procuratorate filed a public prosecution with the Ju County Court on Yu Moumou’s suspicion of illegally hunting precious and endangered wild animals, and Yu Moumou admitted guilt and punishment, sincerely repented, and voluntarily signed the “Confession and Punishment Statement”.
On March 25, 2020, Yu was sentenced by the Ju County People’s Court to four months’ detention, six months’ probation, and a fine of 3,000 yuan on suspicion of illegally hunting precious and endangered wild animals.
The procurator in charge stated that anyone who illegally hunts or kills precious or endangered wild animals under key national protection shall be convicted and punished as the crime of illegally hunting or killing precious or endangered wild animals under key national protection in accordance with the provisions of the first paragraph of article 341 of the Criminal Law.
